These Terms and Conditions (hereinafter called "Conditions") govern the 1865 Programme (hereinafter called "1865" or "Programme") operated by or on behalf of Langham Hotels International Limited (hereinafter called "LHI" or "We") and the relationship between LHI with members (hereinafter called "Members" or "You") of the Programme (hereinafter called "Membership"). Membership of the Programme is subject to these Conditions and their amendments and modifications made by LHI from time to time without prior notice. LHI reserves the right to amend or modify these Conditions or to change, replace, suspend, cancel or discontinue any Programme benefits, services, rewards, rules and regulations at its discretion at any time without any prior notice to Members. By using your 1865 Card or Card Number to redeem benefits and services associated with the Programme, you agree that:

a. you have read, understood and accepted these Conditions;
b. you are eligible for Membership; and
c. you consent to LHI processing your personal data, in accordance with the personal data and privacy policy set out in Section 3.

1. MEMBERSHIP WITH THE PROGRAMME
 
1.1 When you are accepted by us to be the Member of the Programme, you will be assigned a 1865 membership number and will receive your personalised 1865 Card along with details of programme benefits and a list of participating hotels, resorts and residences (collectively hereinafter referred as the "Properties").
1.2 Membership is complimentary and is available only to individuals, not to companies, partnerships, associations, groups or other entities. You may not have more than one membership or any form of joint membership. It is your responsibility to ensure your eligibility and you will indemnify LHI against all liabilities, costs, claims, and/or expenses incurred for any breach of this provision. LHI may refuse Membership without giving a reason.
1.3 Upon successful enrolment, Members automatically receive the 1865 welcome letter along with 1865 membership number and profile login password.
1.4 Any Membership applicant who is currently 1865 Member or has been 1865 Member in the past twelve (12) months, his/her Membership application shall not be considered or accepted by us.
1.5 Membership entitles members to benefits and services according to entitlements as described on 1865 website and relevant further information within these terms and conditions.
1.6 Membership of the 1865 and membership cards are not transferrable and may only be used by the registered member. Membership cards remain the property of LHI and must be returned upon request.
1.7 You may cancel your Membership at any time with written notification to the Hotel and by enclosing your 1865 Card (if any) cut in half. Cancellation is immediately effective upon receipt of your cancellation request and all membership entitlements will be forgone upon such cancellation.
1.8 LHI reserves the right to discontinue the 1865 membership of any Member who is found to be using the Programme in a manner inconsistent with the Terms and Conditions or intent of the Programme or any portion of the Programme. LHI also reserves the right to discontinue membership of any Member who acts in a manner inconsistent with the spirit of the 1865 Programme. Discontinued membership will result in the loss of all membership entitlements.
1.9 Any Member who has not stayed at an 1865 participating hotel at least once in 12 consecutive months may be removed from the list of active Members and if so, is subject to forfeiture of all benefits and services. A Member may reactivate his or her account by any means that LHI may establish.
1.10 1865 digital membership card is downloadable at 1865 member site. 1865 physical membership card (except for Explorer and Chelsea Voyager tiers) will only be sent on request and issued within six to eight weeks after request is received.
1.11 Unless otherwise stated, all benefits available to Members through the Programme are subject to availability and certain benefits may be excluded from certain volume room night agreements.
1.12 Unless specified otherwise at the time of check-in, airline miles will be awarded to the Member's preferred airline frequent flyer programme account for stays where the Member pays an eligible rate.
1.13 A stay is defined as the total number of consecutive nights spent at one property, whether or not a member checks out and checks back in. A back-to-back booking will therefore be counted as one stay only.
1.14 All benefits are restricted to registered 1865 members only and on a per room basis. Only one set of member benefits will be provided should there be two or more 1865 members sharing the same room.
1.15 Valid credit card information must be provided to facilitate settlement of hotel bills and entitlement of certain member benefits. Unless specified otherwise at the time of reservation or check-in, Langham Properties and Langham-affiliated hotels will use the credit card information provided by Members to 1865 for bill settlement purposes.
1.16 LHI reserves the right to add, modify, delete or otherwise change any of the terms, conditions, benefits and services pertaining to the Programme at its sole discretion, at any time and without prior notice.
1.17 1865 Card is a guest recognition membership card and is not a credit card.
1.18 All interpretations of the Programme's Terms and Conditions shall be at the sole discretion of LHI.
2. TIERS OF MEMBERSHIP
 
2.1 Explorer level: Eligible applicant who has been accepted by LHI as Member of the Programme.
2.2 Gateway level: You are eligible for 1865 Gateway membership if you have stayed at Langham Hotels or LHI's affiliated hotels at least three (3) qualifying stays or nine (9) qualifying nights in a calendar year.
2.3 Voyager level: You are eligible for 1865 Voyager membership if you have stayed at Langham Hotels or LHI's affiliated hotels at least five (5) qualifying stays or fifteen (15) qualifying nights in a calendar year.
2.4 Chelsea Voyager level: An exclusive tier for Chelsea Hotel, Toronto guests. Stay at the hotel fifteen (15) qualifying stays or forty five (45) qualifying nights in a calendar year.
2.5 Destiny level: 1865 Destiny membership is reserved for Voyager/ Chelsea Voyager members who show the highest level of commitment. This membership is offered by invitation at the sole discretion of LHI.
2.6 Every effort will be made to invite guests to join 1865 when the above targets are met. However, we ask that you inform us if you have reached these targets and not yet been invited to join the Programme.
2.7 The Programme will not recognise number of stays offered on a complimentary basis or generated from airline crew accounts or room sharers.
2.8 Long-stay agreements are generally specifically contracted for extended periods; hence, certain 1865 benefits may not apply.
3. DATA PRIVACY
 
3.1 The personal data supplied by Members will be used for the operation of the 1865 Programme, delivery of associated benefits and services, programme development and to communicate news and information to Members for their benefits. LHI collects personal data of Members (both offline and online) so as to provide an experience of the 1865 Programme that is tailored to their preferences.
3.2 In addition, LHI will use the personal data supplied by Members for direct marketing activities as detailed in Section 3.3 and 3.4 below. LHI will not use your personal data unless we have received your consent.
3.3 Personal data supplied by Members will be used for direct marketing activities in relation to the following classes of services, products and subjects:
(i) products and services offered by LHI's hotels and properties including accommodation offers, event and catering services, food and beverage services, and spa services
(ii)products and services offered by LHI's partners including airlines, frequent flyer programmes, travel partners, car rental companies, financial institutions, credit card companies, retail partners and real estate companies.
3.4 LHI shall use the following personal data held by us from time to time for the direct marketing activities detailed in Section 3.3:

(ii) Email
(iii) Address
(iv) Phone no.
(v) Birthday
3.5 Since the privacy of Members is of paramount importance to LHI, we wish to protect it and maintain the trust of our Members while collecting the information necessary to operate this Programme. LHI is fully committed to providing information about the collection and use of personal data furnished by, or collected from, Members while using our websites, products and services.. If you do not wish LHI to use your personal data for use in direct marketing as described, you may exercise your opt-out right by notifying us at any time without charge, via email at 1865@langhamhotels.com.
3.6 Members have the right to review, amend and update any personal data held by LHI. Members' contact details, profiles and guest histories can be accessed at any time online by individual Members. The Member-restricted access is password-secured and allows you to view your accumulated stays as well as to change your contact details and personal preferences.
3.7 Members have the responsibility of keeping 1865 up-to-date as to their correct communication/postal address.
3.8 LHI will only use and disclose Members' data to the companies within the Group, their successors, and any vendors and suppliers including system developers, campaign management companies, call centres, research companies, fulfilment companies and telecom service providers LHI engages to process data on its behalf for the purpose of operating this Programme as detailed in Section 3.1.
4. GENERAL
 
4.1 These Terms and Conditions and the relationship between 1865 Members and Langham Hotels International Limited are governed by, and shall be construed in accordance with, the laws of Hong Kong SAR.
4.2 "Langham Properties and LHI's affiliated hotels" include all 1865 participating hotels. Please check the LHI website for details.
4.3 Members shall indemnify and hold harmless LHI, its officers, directors, employees and agents (collectively "Representatives") from and against any and all liabilities, damages, losses, expenses, claims, demands, suits, fines or judgements (including, without limitation, any reasonable legal fees, costs and related expenses) incurred or suffered by LHI and its Representatives as a result of any claims or proceedings brought by any third party, arising out of or in connection with any breach of obligations hereunder or negligence or wilful misconduct on the part of a Member.
4.4 In the event of any inconsistency between the Chinese and English versions, the English version shall prevail.
